These Terms of Service (“Terms”) govern your access to kyniqo.com, your purchase and use of KYNIQO hardware, software, games, content, support, and related services (collectively, the “Services”). By accessing the Services or placing an order, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and family use

You must be legally able to enter into a binding agreement in your location. If a child uses KYNIQO, a parent or legal guardian must supervise the child, review these Terms, and accept responsibility for the child’s use. Always follow setup instructions, maintain a clear play area, use reasonable care, and stop play if anyone feels unwell.

2. Accounts and information

You are responsible for keeping account credentials secure and for providing accurate, current information. Notify us promptly of suspected unauthorized access. You may not impersonate another person or use the Services for unlawful, harmful, or fraudulent activity.

3. Orders, pricing, and payment

All orders are subject to acceptance, product availability, and fraud screening. Prices, promotions, taxes, and shipping charges may change before an order is accepted. We may correct errors, refuse or cancel an order, or limit quantities. If we cancel an order after charging you, we will refund the affected amount to the original payment method.

4. Delivery, returns, and warranty

Delivery estimates are not guarantees. Risk of loss and title pass as provided by applicable law and the carrier arrangement. Returns and refunds are governed by our Return and Refund Policy. Eligible hardware is covered by our One-Year Limited Warranty. These policies form part of these Terms.

5. Limited license

Subject to these Terms, KYNIQO grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for household, non-commercial entertainment. The Services are licensed, not sold. You may not copy, reverse engineer, circumvent security or access controls, resell access, extract data, interfere with networks, or use the Services to violate law or another person’s rights, except where such restrictions are prohibited by law.

6. Software, games, and updates

Features, game availability, compatibility, and online functions may change over time. We may provide patches, security updates, or feature updates. Some updates may be required for continued operation. Third-party content may be subject to additional terms. We do not promise that every feature or title will remain available indefinitely.

7. Intellectual property

The Services, including KYNIQO names, logos, designs, software, graphics, audio, video, text, and game content, are owned by KYNIQO or its licensors and protected by intellectual-property laws. No rights are granted except the limited license expressly stated in these Terms.

8. Feedback

If you voluntarily submit ideas or feedback, you grant us permission to use them without restriction or compensation, while we will continue to handle any personal information in accordance with our Privacy Policy.

9. Service availability

We work to keep the Services available and secure, but they may be interrupted for maintenance, updates, network conditions, safety, or circumstances outside our control. We may suspend access where reasonably necessary to protect users, KYNIQO, or third parties.

10. Disclaimers

Except for our express limited warranty and rights that cannot be excluded by law, the Services are provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. KYNIQO is an entertainment product and is not medical, fitness, or safety equipment.

11. Limitation of liability

To the maximum extent permitted by law, KYNIQO will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or loss of use arising from the Services. Our aggregate liability for a claim will not exceed the amount you paid for the product or Service giving rise to that claim during the twelve months before the event. Nothing in these Terms limits liability that cannot legally be limited.

12. Indemnity

To the extent permitted by law, you agree to indemnify KYNIQO against third-party claims resulting from your unlawful use of the Services or material breach of these Terms.

13. Changes

We may update these Terms. The revised date will appear at the top. Material changes will apply prospectively, and continued use after they take effect means you accept the updated Terms.

14. Governing principles

These Terms are governed by the laws that apply to KYNIQO’s sale to you, without depriving you of mandatory consumer protections in your place of residence. Before starting a formal claim, please contact us so we can try to resolve the issue informally.

15. General

If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a business reorganization or sale, subject to applicable law.
